BMS objections on the new Code on Industrial Relations, 2020
BMS and other trade unions have given detailed objections to the previous draft of the Industrial Relations Code. None of the objections raised by BMS and other trade unions as well as the recommendations of PSCL (Parliamentary Standing Committee on Labour) in favour of workers are considered in the revised draft.
It is further tilted too much in favour of the employers and bureaucrats;and the last minute mutilationswill adversely affect industrial peace in the country.Some important changes like that on standing orders are not even discussed in the consultation process; which will be a violation of ILO convention 144 ratified by Indian Parliament. There is clear attempt to diminish the role of trade unions. The danger of bureaucrats replacing parliament is too much apparent in the IR Code, which may lead to constitutional issues. Even Supreme Court directions on constitutionality of some provisions are violated. Thus purpose of codification is defeated.
BMS opposes the following new changes:

Industrial Employment Standing Orders law is exempted for industries up to 300 workers is highly objectionable. At present it is 100 in statute and 50 in many states.

In fact 2nd NCL has proposed to bring down the threshold for framing of standing orders from 50 to 20 workers.

PSCL also opposed exemptions on standing orders saying “it can potentially create uncertainty in the minds of the Stakeholders”.

Further MOLE told PSCL- “Model Standing Orders, Certification of Standing Order have not been changed as these are functioning well."

PSCL recommended a time limit of 45 days for registering a trade union. This was a long pending demand of joint trade unions. Still it was not included, whereas for permission to employers for lay off, retrenchment and closure, time limit of 60 days prescribed.

In the new provision of sole negotiating union,eligibility is a mere 51% or more.In the previous draft it was 75%. This is an overt attempt to monopolise single union and eliminate all other unions.

In the new provision, the eligibility for negotiating council of trade unionsis “not less than 20% of total workers”. In the previous draft it was not less than 10%.

The most controversial chapter VB (now Chapter X) on prior permission for lay off, retrenchment and closure is exempted upto three hundred workers.It will promote “ease

PSCL has criticised parliament’s power being replaced by arbitrary decision of government at 100 places in the code. This remains unchanged in the new draft. There is a larger regime of exemptions throughout the IR Code at the discretion of bureaucrats.
Bureaucrats who have held the post ofjoint secretary rank will be additional member in every tribunaltill the age of 65 years;when labour courts are also are getting converted to tribunals. Bureaucrats themselves will fix their salary and allowances which cannot be changed later. In the previous draft, persons with ability, knowledge and experience was the criteria. That is now replaced by mere joint secretary rank. But Supreme Court has decided against non-judicial members in Tribunals in Madras Bar Association case in 2010.
PSCL has opposed the provision giving power to bureaucracy to nullify awards, on
the ground that the idea was struck down by High Courts of Andhra and Madras in
2004 and 2014 as unconstitutional. Still it is retained.
There is a new exemption provision saying, while making rules,bureaucracy can
dispense with the condition of previous publication of such rules for public scrutiny.

anti-worker provisions, on which a statement is attached here with. Nothing is considered in
the new Draft.
The ensuing National Conference of BMS to be held on 2, 3 & 4, October 2020 will decide
the future course of action on the anti-worker provisions in the Labour Codes.

Smt Kamala G Jirgal & 2. Smt Umarani (mother of Sri M D Umarani. The first application has already been submitted. Umarani is going to submit application shortly. The write up is already uploaded in NOIP blog under Pension Matters. I think in all older Divisions there may be one / two cases of such nature. Our activists should make efforts to trace eligible persons & help them in claiming Ex-gratia.

The Class 1 Officers of LIC lost Wage Revision due on 01-04-1973. Where as class 3 and 4
clinched the Settlement. The above scales only continued to Class 1 Officers till next Wage
Revision in 1983. This resulted in anamoly and at one point of time a Suptd in Class 3 was
drawing more salary than an AAO. The result was refusal of Promotion to Class 1 Cadre. An
Interim Relief was granted in 1978 ranging between Rs.75/- to Rs.250/-.
DA : Payable whenever there is 6 points rise / fall in DA payable to Class III @ Rs.40/-. No DA was
released wef. Nov 1974. From May, 1976 Govt., allowed release of DA @ Rs.20/-(reduced by 50%).
In 1980 an Increase in DA from Rs.20/- to Rs.30/- was granted for every rise / fall of 8 points in CPI.
This was also arbitrarily stopped by Govt., from Nov, 1980.

of more than Rs.2426/-.
Not withstanding what is stated above, a) the DA payable at any stage of Basic Pay for each cycle of
24 points rise, shall not be less than the DA payable at the rate 3.9% or Rs.150/- whichever is less; &
b) if any time the DA payable in accordance with these rules, at any stage of Basic Pay, is less than
that admissible for a lower Basic Pay, the DA payable at the relevant higher stage shall be equal to the
DA payable for the lower BP.
A) The downward revision of the DA payable to Class 1 Officers in the respective ranges of BP, if the
Qly av. Of the index fall below the respective sequences of 332-348-356-372 etc for ii) above and
332-356-380-404 etc for iii) above.
B) On the downward revision, DA payable shall corrospond to the Current Average figure is a figure
in the above relevant sequence; and the DA payable shall corrospond to the figure in the relevant
sequence next preceding the Current Av. Figure, if such Current figure is not a figure in the sequence.
The increase in DA granted will apply to Class 1 officers who have retired or died between the
effective date and the date of CO circular conveying the decision. However, it is NOT applicable to
those Class 1 Officers who have resigned / removed / dismissed under Reg. 39 between the said dates.

LIC Pension Matters
REGULAR PENSION (A)
Main Chapters covered are IV, V and VI of the LIC Pension Rules, 1995. Also reference may be had to Appendix II, III & IV. The sum and substance of these Rules under these Chapters and Appendixes are as given below :

The Pension rules were made applicable from 01-11-1993.

Option was given to those Retired after 01-01-1986. They can choose to be covered by the
Pension rules, subject to certain conditions. However, NO pension arrears are payable from 01-
01-1986 to 31-10-1993.

The Pension granted is Index Linked (Base 1960=100).

Dearness Relief payable are set forth in Appendix IV.

The employee who has rendered a minimum of 10 years of Service in the Corporation is
eligible for the Pension.
TEN REASONS TO JOIN “NOIP”
1. National Organisation of Insurance Pensioners is the only pensioners' organisation registered under the Indian Trade Union Act, 1926.
2. “NOIP” is affiliated to Bharatiya Mazdoor Sangh which is the largest and Numero Uno Central Trade Union in the country, duly recognised by the GOI.
3. Keep the members updated on real time basis about various matters connected with the pensioners, through mail, sms, what’s app in addition to postal correspondence.
4. Quarterly meeting is held with the officials of the LIC Central Office by our All India leadership raising various burning issues of pensioners, thereby keeping the management well aware of the pensioners’ problems.
5. Helping the members of each unit of NOIP (including family pensioners) by local office bearers in case any problems with the office, health or mediclaim settlement.
6 .NOIP is the first organisation which has submitted the “Charter of Demands” to the LIC Management containing the burning issues of pensioners.
7. NOIP is represented by all classes of LIC Pensioners.
8. Connectivity amongst the members is kept alive by visiting the members’ residences at local unit level creating relationship and bonding which is necessary especially after retirement.
9. All India Conference is held once in three years and All India Central Committee /Secretariat Meeting is held once in six months for taking stock on current issues.
10. NOIP brings all likeminded nationalist people under one banner and caring for the welfare of the society at large. The organisation encourages the members to spare some time for social work. Many of our members are involved actively in various social activities at their respective place/ field.

Re: Provision of cashless facility to the policyholders
- It has been brought to the notice of authority that certain hospitals are denying cashless facility to policyholders for treatment of covid-19.
- Attention is drawn to the provisions of regulation 31 (d) of IRDAI (Health insurance) Regulations, 2016 wherein every general and health insurance company shall endeavour to enter into agreements with adequate number of both public and private sector network providers across the geographical spread.
- Further, in terms of Regulation 31 (a) of IRDAI (Health Insurance) Regulations, 2016, general and health insurance companies may offer policies providing cashless services to the policyholders. For the purpose of providing cashless services insurers / Third Party Administrators (TPAs) shall enlist network providers (hospitals) to provide medical services and shall also enter in to a service level agreement.
