Sub: Tax exemption for Leave Encashment

You are aware that in the Central Budget presented by H'ble FM on 01/02/2023, the limit of

leave encashment on retirement, stands enhanced to Rs 25 Lakhs. The said limit can be given

effect to for implementation only after the same is notified by the CBDT. We hope you are in

the process of issuing the same. We may bring to your kind notice that on the previous occasion

when the limit was raised to Rs.3 Lakhs in 2002, the Notification provided retrospective

applicability from 1998. The present enhancement to Rs.25 Lakhs has come about after a long

gap of time, during which period many employees who retired were compelled to avail the limit

of Rs.3 Lakhs only; while the Central and State Govt employees were allowed to avail the

benefit of tax-free leave encashment by virtue of applicable rules. In order to give similar

benefit to the employees of other sectors and to maintain equity, we request you to notify the

enhancement of limit to Rs 25 Lakhs with retrospective effect from 01-01-2006 and oblige.

We await the favourable orders from your end at an early date.

Bharatiya Mazdoor Sangh, wherein you were kind enough to discuss all the 8 pending issues of LIC’s 

pensioners at length. You had assured us that the family pension enhancement notification along with 

other issues recommended by the LIC, would be resolved at the earliest. But to our utter dismay, we are 

yet to get the desired justice from your end.

For your ready reference, we attach herewith the copy of the letter dtd 25-02-2023, addressed to the 

Honourable Finance Minister. 

We once again implore upon you to immediately facilitate the necessary notification giving accord to the 

issues vide items B, C, D, E & H , that have been supposedly recommended by the LIC.

Re: Retired Employees’ Portal.

At the outset we would like to congratulate you on your appointment as Chairperson of the premier

financial institution. We are sure under your leadership, LIC would scale new heights in the days to

come.

We recall the meeting NOIP delegation had with you on 19-10-2022, where in the issues of Pensioners

were discussed at length. We are glad that one of the issues raised has been addressed viz Portal for

Retired Employees. We thank you for the same.

However, many of the Pensioners were NOT able to register themselves in the Portal. When the SR No,

DOB, and Mobile number are given, the Portal flashed a message “WRONG DATA”, thereby denying

entry to lot of Pensioners to the Portal. The Tickets raised by them have also not been attended. We

request you to instruct the concerned to take rectification action immediately.

NOIP also suggests the following improvements to be brought in the Portal, to make it still more

comprehensive.

1. Profile option: a) Many of our Pensioners have reported that the Qualifying Service shown as 33

years, even though they have put in more than 33 years say 36, 37, 38 years etc. It is always

better to show the exact Qualifying Service put in by the Pensioner/Retired employee. (b) Some

of the dates are wrongly stated ie date of birth of spouse etc. Provision may be made to update

the profile.

2. Circulars & Forms: Majority of the Circulars posted herein pertain to Mediclaim Policy; except

OMOP circulars of 2019 & GIS circular of 2019. We implore upon you to instruct the concerned

department to upload all CO Circulars right from 05-07-1995 pertaining to Pension and

Pensioners and latest GIS circulars. The LIC (Employees) Pension Rules, 1995 fully updated with

latest amendments, may please be uploaded here.

3. Yogakshema: We appreciate the uploading of soft copy of our house magazine.

4. Jeevan Saakshya: The User Guide will definitely help Pensioners in submitting EC online.

5. MediClaim: The details may please be updated every year as soon as the Medi Claim policy is

renewed. Yet to upload 2023 details.

6. Pension Details: Pension payment details from May 2022 to Jan 2023 are available, with a

provision to download the Pension Slip. We urge upon you to make provision for a) Financial

year data ie from March to February of every year, b) Income Tax reviews every quarter may be

made available, c) There should be a provision to upload Savings details by the Pensioners, d)

Form number 16 at the end of the year should be made available here.

7. General: In this Portal the following options may also be provided.

A) Provision to book Guest House.

B) Statistics of Pensioners year wise from 1995-96 onwards.

C) Pension Fund details such as Income & Expenditure Statement, Balance Sheet from 31-03-1996

onwards till date.

D) Feedback Section may be created so that the Portal gets improved.

above suggestions are given due consideration and seriousness they deserve.

Latest development regarding FP notification

You may be aware that we were in constant touch with Shri.Prakash Javadekar ji, H’ble

Chairman, Ethics Committee of Rajya Sabha for helping us in the early notification of family

pension enhancement. We wrote to him on 25-02-2023. After we had detailed discussions in

DFS (Dept of Financial Services) on 02-03-2023 at the intervention of BMS; NOIP delegation met

Shri. Javadekar ji in Pune on 09-03-2023 and briefed him of our discussions in DFS. It was a

detailed discussion with him for half an hour and he assured that he would follow up with the

Finance Minister. Again on 21-0-2023, we sent a gentle reminder to him. The notification is

delayed inordinately, is our real concern.

Fortunately, today early morning, our Pune activists could contact him on phone. He was kind

enough to talk elaborately about the efforts made by him in this regard. Immediately after we

met him on 9th March, he wrote personally to the FM attaching our letter to her and requesting

an early notification. He did receive her reply. Since the notification was further delayed, he

sent one more letter to her requesting notification for LIC’s family pensioners, saying, LIC has

agreed to bear the cost.

He assured us today that he would seek FM’s appointment and urge her for immediate

notification. He also confirmed that FM is busy in international affairs. Since she is back to India

from USA tour, he would seek her early appointment.

We have also requested Shri. Girish Aryaji, In charge, Financial Sector of BMS in Patna and again

2 days back, for follow up with the finance ministry. He has assured to do the needful.

We reassure all our members and family pensioners that we will leave no stone unturned to

ensure the early notification.

A brief Report of 20th Triennial conference of BMS

The 20th Triennial conference of BMS was held at Patna on 7th, 8th and 9th of April

2023.

07.04.2023-

State wise meetings were held and instructions were given to all delegates about the

modalities of the conference, do’s and don’ts.

The conference started with Dhwajarohan. (Flag hoisting).

The Inaugural session started with singing of Vande Matharam and Adhiveshan Geeth

followed by Deepa Prajwalan.

The inaugural session was presided over by Sri Hiranmay Pandyaji, President, BMS. In

his address he explained three pillars- Rashtra hit, Udyoga hit, Shramika hit on which

BMS works.

Sri Ravindra Himateji, General Secretary, BMS shared the

dais.

Chief guest-Sri Bhagaiah ji, Rashtreeya Swayamsevak Sangh Kendra karyakari

Sadasya and Patron, BMS, inaugurated the conference.

Smt Sita Sahu, Mayor of Patna (BJP) and Sri Syed Sultan Uddin Ahmed, Specialist on

Workers Activities, ILO, Southeast Asia, graced the occasion.

Sri Sachin Chandra, President, CII, Bihar, the other guest present, in his address said

that the subjects on which deliberations and discussions that would happen and

decisions that would be taken in this conference will be a guide to the working class of

world at large.

Representatives of INTUC and TUCC unions also spoke.

Later, a special session was held on L20 at G20.

It’s a great pride that the BMS is heading the L20 while the G20 is led by India.

The General Secretary, Sri Ravindra Himateji submitted his report on the activities of

BMS and the same was approved.

The Finance Secretary submitted the Statement of accounts and Balance Sheet.

It was accepted with a minor correction.

Industry wise meetings were held and in the Insurance sector meeting Sri T C Gunesh

Kumar, President and Sri Ashok Joshi, General Secretary represented NOIP and urged

for intervention of BMS in immediate issue of notification of the Revision of Family

Pension and in realising of other long pending demands of NOIP.

08.04.2023-

A special session was held about “Different dimensions of Mahila karya.” Smt Asha

Lakra a BMS activist from Jharkhand and Mayor of Ranchi (BJP), Smt Sita Sahu (BJP)

Mayor Patna and Smt. Pradnya Parande of VV Giri Foundation, were on the dais and

guided the delegates especially the lady delegates.

A grand shobha yatra covering more than 4 kms in the Patna city culminated at Mangal

Talav grounds where a public meeting was held which was presided by Sri Sukhvinder

Singh Dikki, All India Vice President.

In the evening a Cultural program was held where delegates of different states exhibited

their talents.

09.04.2023

In the special session Sri Bhagaiah j spoke at length on BMS 70- Future thrust and

direction.

A Vyavastha Parichay- thanks giving to all responsible for successful conducting of the

conference was held followed by a detailing about Future Programmes of BMS.

2491 delegates attended the conference from all the registered unions and all the

States.

2. Amendments to the Contract Labour (Regulation & Abolition) Act, 1970

3. National labour policy should be made in the present context

4. Fixation of Living Wages instead of Minimum Wages

participated and 2 new enrolments were made on the spot.

Re: Renewal of Medi Claim Policy for the year 2023-24 with New India Assurance

Co Ltd

At the outset we would like to thank you for considering our demand for Increase in Compulsory

Floater Sum Insured for all Categories. You were kind enough to merge Cat III into Cat II raising

the CSI to Rs.10 Lakhs and for Cat I CSI is raised to Rs.15 Lakhs. The Pensioners remain

grateful to you.

However, many more aspirations of Pensioners were not considered while negotiating with NIA

and convincing them to accede to the following genuine demands.

1. One more chance to join the Scheme – for those who, for whatever reason are left out of

the Scheme. Last time option to join was given in 2011. It is now 12 years, at least this

time option to left outs ought to have had been given. Even now it is not too late, LIC

can impress upon the NIA to accede to this option and allow left out persons to join

the Scheme.

2. Dental treatment is excluded in our Medi Claim Policy, which is very much required at

old age and we urge upon you to intervene and ensure inclusion of Dental treatment in

our Policy.

3. Preventive Health Checkup at older age is essential. But ironically, they are not given this

facility. Health checkup every year may be allowed to Pensioners or Cash Medical

Benefit may be granted.

4. Room rent, as a separate entity was first time introduced in the Policy year 2014-15 with

1.5% of Sum Insured subject to a maximum of Rs.7,500/- per day, irrespective of place of

admission. However, in 2015-16, Room rent was based on Class of city. Places were

divided into A, B and other places. Whereas for A class cities it remained Rs.7,500/- for B

class cities it was brought down to Rs.5,000/- and for other places it was reduced to

Rs.4,000/- per day. However subsequently the Room rent in A class cities for TSI of

Rs.40 L & Rs.50 L got increased and for B City increased in 2020-21. For other

places remained static since 2015-16. Hospitals, especially after Covid period have

increased the Room rent. Hence, an increase in room rent for other places may also

be considered favourably.

5. Option to include Independent Children should be kept open every year.

6. For the first time GST on premium paid by the Insured is to be borne by him/her only.

The Insurer has also increased Tabular Premium. With the result the benefit of Increase

in Basic Compulsory Sum Insured has NOT benefited many senior citizens. They

are required to pay more premium than what they were paying last year.

We implore upon you to have a second look on the above matters and expect a favourable

decision at your end.

To all the Members

Renewal of Group MediClaim policy 2023-24

Certain salient features for information of our members.

1. TPA is unchanged, I.e., same TPA will continue for service of Claim settlement as it was last year and

same procedures for cashless and reimbursement claim.

2. There's a change in compulsory family Floater Sum Insured, instead of three, only two Categories.

A. Cat. II up to basic salary 96,139, Compulsory Floater S.A 10 LAC

B. Cat. I from basic 96,140 onwards. Compulsory Floater Sum assured 15 LAC.

3. Sharing of premium- No change

4. 18% GST on total premium paid by the retiree.

a. G.S.T on subsidy premium will be borne by Corporation.

b. PF OPTEE, has to deposit annual premium along with applicable GST.

5. There is increase in premium for all age groups. For younger ages +14.84% and for higher ages +5.84%

6. Shifted GST payment on us, first time, which has increased the premium for all groups, is very much

disappointing.

7. Premium calculation.

You can use the ready reckoner already shared, which is prepared by Shri. C T Joshi ji.

8. There is no change in Room rent.

We have come to know from reliable sources that, three cities are upgraded to A category, namely,

Howrah, Kanpur and Patna, where maximum room rent will be 10,000 if Floater Sum insured is 40 lac or

above, and three cities namely Gorakhpur, Guntur and Ranchi are upgraded to category B. Now

maximum rent can be allowed Rs.6000/-

9.Contrast MRI AND CONTRAST ANGEO CT/CT SCAN are reimbursable for maximum Rs.12,000 and

Rs.9000/- respectively, Diagnostic Tests without Hospitalization.

10. We have given many suggestions like one more option for all left out employees to join the scheme,

reimbursement of OPD TREATMENT, DENTAL TREATMENT, PREVENTIVE HEALTH CHECKUP BENEFITS,

Hospital Cash benefits, increase in Room rent (it should be exclusive one and no charge be combined

with room rent), increase in pre and post hospitalization limit to 60/120 days etc. But none is

considered. We will continue to pursue the same with LIC Management.
